Do I have a sexual harassment case? How do I go about it?



My boss touched me on my buttocks twice within a 3-4 week timeframe. I didnt report him bcz I was afraid of what would happen to my position and I also didnt want to go through the drama and hassles involved in situations like this, I also did not want to get HIM into trouble and cause him to lose his job. However, after the 2nd time he touched me, I confronted him and he apologized but I felt uncomfortable being around him after that and I reported him. I've since been taken off of my job working for him and I am working elsewhere within the firm, they are handling him (I dont know what's going on yet but he's received calls and things ARE going on right now as I type this question). What I want to know is, do I have a sexual harassment case regardless of whether the firm is doing their part or do I have to wait to see whether he's fired or resigns, what are my options, what happens in cases like this and what options do I have? Do I do a lawsuit anyway?

If they are taking care of him, then it may be better to avoid further controversy.
yes it is sexual harrassment. and no i wouldn't law suit against it. if u got raped sure law suit then but not now. it's highschool play. everybody in highschool does that everyday! so just watch ur self.
You only have a legal case once administrative channels are exhausted.
A case against a company would imply that the company condones or ignores sexual harassment. The fact that they are reacting to your complain implies that they are doing what they should. Why would anyone sue them?
The only way I see this can be presented as a law suit is if the company created an environment where sexual harassment is condoned. It does not seem to be the case, but if it were ...
Nope. Once you stated to him that his actions were unwanted, he stopped. End of the story.
Feeling victimized is very difficult and very uncomfortable. I would go to whoever is supposedly "handling" this and tell them point blank, "I am very uncomfortable working here with him in the same office, and unless he is fired, I will be forced to quit and file suit against the company." ...

I was in the same situation a few years back, where a "head honcho" made some rather sexual remarks & gestures towards me & I became extremely upset. I felt dirty & victimized & very uncomfortable walking around the office. I came to work the next day hoping for improvement, but couldn't even walk with my head up. I told human resources about it, and they allowed me to go home while the spoke with him. They called & told me they spoke to him & he promised it won't happen again. This made me feel even more uncomfortable, and I knew it would be impossible to work in the same office. I didn't bother going into work the following day, and they fired ME!!!
If the company is helping you, you may not have as strong a case. They moved you away from him & know the problem. They want to avoid a lawsuit, & are doing things to help you.
If he continues, & they don't do anything, you have a better chance. Lawsuits are if the company isn't taking care of you & it sounds as though they are.
