This evil credit card law firm type place froze my bank account! Can they garnish my wages too?????



They put a hold on my checking account. They froze it because I was not paying some over due credit card. I paid off my credit cards though! I called & they were nasty to me when I explained I couldn't afford to pay the whole balance. I told them these charges were not even done by me because my wallet was stolen. They didn't seem to care or even believe that. I said I would make payment arrangements. They at first didn't agree to that but gave in. So I gave them something but not enough to pay it off. Can they garnish my checks now? I don't have any more bank accounts. I cash my checks at those check cashing places or I have one of those debit cards sorta like direct deposit only it's not my personal bank account it's it's own. I don't think I should have to pay for something I didn't do! I'm almost 100% sure I didn't make those charges but I can't prove that & I don't wanna give them anymore $ but I'm worried they will come after my pay now! Can they do that??

Well first if the charges were not yours why did you offer a payment arrangement. If they were not yours you could have filed a police report and fought the charges.

Probably not what you want to hear but by the time they freeze your bank account they have already filed suit aginst you and have won a judgement. So did you ignore the summons? Once they have the judgement any defense on it was not your charges is pretty much gone. You are going to have to come up with the money.

Generally the first thing they will do is attempt to garnish your wages. If you live in a state where this is not possible, or you don't earn what they consider enough they go after your accounts. So you are resonably(but might not be 100%) safe in them going after your wages now. But until it is paid off ANY account you open and they find it they will take the money. If they can't find any accounts in a while they may take the next step and attempt to place liens on any property you may own, such as a house or car. If they do this you will not be able to sell the item until you have paid back the debt.

Think of this as a lesson learned and if you ever get your wallet stolen, dispute and fight any charges that were not yours. Don't ignore them and hope it goes away.
They shouldn't be able to freeze your checking account without winning a lawsuit. Then they would have to get the court to agree to freeze or attach your assets, which could include your bank accounts, a home you own, your salary through garnishment, etc.

You don't say that they won a lawsuit, only that they froze your account. If they haven't won a lawsuit, and they did this without any court's permission, you can and should sue them.
The short of this answer would be what I would personally do

A. Call my bank
B.Call the Attorney Generals office
( State Office)

they usually have low cost or free legal advice

Do this ASAP
