EDD Disability and/or workman's comp question......? |
Let me preface this with that I have never received or applied for disability, workman's comp or Unemployment. So I'm not sure how this goes. I got fired from my job because I let them know that I wanted to see a psychiatrist, I was feeling depressed, high anxiety and semi-suicidal, which all the doctor confirmed. He told me to apply for disability. I got the paperwork from EDD and filled it out and had my Doctor fill out his half. EDD now has sent me 2 different letters. The first says I can also apply for Workman's comp, but I have to cancel the disability if I get both. The second is a Notice of Computation, which I think is tells me what I might get. I'm not sure on what the next step is I should take. Does anyone have any suggestions? I would prefer someone who has been through something similiar or even works for EDD. Thanks!!!!! I can't really help you with the EDD stuff, but I do know that you could not really file with work comp unless there was an incident/accident at work that caused all of the problems you're having. For example, we had a woman who was attacked and almost raped while working, in a case like that, we would pay for therapy. I believe if you did file a claim, it would most likely be denied as there was no specific accident or incident (as far as I know from what you have said). I think that it's not right that they fired you for wanting to see a psychiatrist, that is unless you were a danger to others. I don't really know anything about wrongful termination, but if you liked your job, you may want to look into that. Source(s): I'm a work comp claims adjuster. |
