Are they obligated to pay vacation pay if you quit? |
We are in Ohio and my husband left his company on good terms. He found another job and gave them notice. He worked for the company for 5 years and had two more weeks of vacation coming to him for this year. Is the company required to pay the balance of his accrued vacation time or is that not something they do? My husband says they will pay, I say they won't....his company was HHGREGG, if that makes a difference. Thanks, any information or websites with information would be appriciated. It depends on what the company's policy is. Pull out the handbook your husband was provided and see if they accrue vacation, and he is entitled to that accrued amount, or if he forfeits any unused time. It varies from company to company. different companies have different policies -- most large companies treat vacation as a cost and accrue it on their books so when someone leaves the the work force they will pay vacation accrued Unused vacation pay and sick pay - There are only a few states with laws that give ex-employees the right to benefit from unused vacation pay (which some companies pro-rate or accrue) or sick leave pay. It is better to go through the company鈥檚 policy guide and the state鈥檚 relevant law before asking for it. If employers allow vacation pay to accumulate, in some states they must offer the accumulated vacation pay when employment ends. These states include: California Illinois Iowa Louisiana Maine Massachusetts North Carolina Oregon Rhode Island Tennessee Whether or not unused vacation pay is given also depends upon the reason for the employee鈥檚 termination. If the employee is fired for misconduct, he/she might have to forgo unused vacation pay. Even regarding sick pay, it depends upon the state鈥檚 law (however, most states don鈥檛 have such a provision) as well as the employment agreement and the company鈥檚 policy. However, unused sick pay is never covered under a severance package. |
