Still haven't received his last pay check and it's been 3 weeks.? |
My fiance worked at Aaron's sales and lease for only 3 days (he quit on a friday). His boss told him he'd have his check within a week afterwards. Well, he's been calling every week and the boss is "never there" to talk to him and it's been 3 weeks and still nothing. They said the put it in the mail on friday, but they're local. Don't you think it'd be here by now? Has anyone ever had the same problem and what do you think he should do to get paid so we can buy food? An corporation is like a tree full of monkeys, all on different limbs at different levels, some climbing up and some merely fooling around. The monkeys at the top look down and see a tree full of smiling faces. The monkeys at the bottom look up and see nothing but @ss holes!! I would go to the place and request to speak with someone to his higher on the chain of command than his old boss. Let them know your situation but be calm about it. I know that would be hard but its the best way to get a point accross. If that doesn't work. I would probably contact someone who can help like a lawyer. Sometimes getting a lawyer to write a letter to a company will get them moving to prevent any legal battles. Good luck. I have never had this experiance but you must be aware that according to US law a company is not required to pay for training of an employee...so they might not be required to pay for his 3 days...maybe if your fiance was more responsible and worked a steady job you wouldn't need a 3 day check to pay for food! If you don't have it by Monday, call the local unemployment office and ask if anyone else has had problems getting their final pay from this company. Depending on what state you live in, they are required to pay within a certain number of days. They also have to provide proof that they have released the check. You don't say what state you are in, so I will give you the federal answer: You MUST receive your final pay by the next regular payday. If that date has passed, then the company is in violation unless they can prove a check was issued and sent out. I would contact the payroll department first thing Monday morning, ask them to stop payment on the check they state they have issued. The payroll department should have a form for your fiance to sign stating he did not receive the check...This should also have the information for the check they issued. Most payroll departments will not issue a new check for 24 hours (takes that long for the stop payment to be active) If they refuse to do this, contact your local labor board. 20 yrs payroll experience |
