A waiter makes less than minimum wage. Considering this, can he still draw unemploymen?

The state only uses your reason of termination and your earnings for the calendar year up to the day of termination in order to determine whether or not you are eligible. As far as I know your position and full-time/part-time status do not enter into the decision.

(1) You have to be unemployed through no fault of your own.
(2) You must have earned a specific minimum (varies by state) over the calendar year.
(3) Apply with the state's work search program.
All of the above are required in order get approval to begin receiving benefits (payments). Once approved the waiter can continue collecting benefits as long as he/she is actively searching for appropriate work.

Most states use a formula based on that state's minimum wage.

So take your total weekly W-2 earnings and divide by (usually 30) to arrive at your hourly wage. Is it more than minimum wage? Did you average enough pay to hit 30x the minimum wage?

This varies greatly from state to state. And reality check here, you are a waiter, no matter how bad your local economy you should be able to find another job.
