Yes, it would be an illegal question to ask from a private employer.

You can ask "are you legally authorized to work in the U.S." you can ask someone if they require sponsorship to work in the U.S. You can ask someone "if hired would you be able to provide documentation according to the I-9 form of authorization to work in the U.S.
no. The military has different standings on employment then typical companies.
what law would they be breaking? it is illegal to discriminate on national origin, assuming you have proper citizenship or working papers.
Sounds illegal to me, try proving it though, wont happen. They can get away with discrimination left and right and there is ABSOLUTELY NOTHING YOU CAN DO.

I don't know, maybe check out the EEOC website. If you are an USA citizen, it may be a biased type question, and it might actually be considered to be discrimination if the person assumes you to be a racial type, and possibly an illegal alien.
