How can you avoid libel? The easiest and best defense for libel is the truth. You can't libel someone if what you are saying is the truth, even if it is defamatory. It can still be defamatory, but as long as it is the truth, then it is not libel. The other easy tip to remember is that opinion is clearly protected speech, so if you make a statement and make it clear that it is your opinion and not an untrue recitation of fact, then you will be safe. The other factor that makes libel defense easier is if you can somehow tie the subject of the statement to being some kind of 'public figure.' For public figures the standard of proof of libel is escalated by the necessity to prove the libelous statement was made will either malice aforethought or reckless disregard for the truth. Don't lie, don't name names, and don't publish. Make sure you can back up any statements you make with witnesses or documentation. Don't say anything about someone or anyone that isn't the truth. Libel is saying stuff that is not true to reduce the reputation of that company or person. If it's the truth, then it's just the truth, whether they like it or not. Don't put anything in writing. |
