Accident and hurt? |
hi i am a truck and few days ago when i am just excited from truck hit by a car i have some seroius injuries on basic of incident report i have 50/50 chance police take this case as a non fault case from both of view (car driver and me none issue any ticket or arrest)please tell me what can i do Well, the POLICE do not determine fault, sorry. There are standards of fault, and entering & exiting a vehicle IS a standard of fault. So more than likely, YOU will be found at fault. You need to treat your medical issues. If you want to sue the other driver, I'd consult a lawyer first, for one of those free consults - he'll tell you if you were at fault or not, but you might end up having to pay out of pocket for the lawyer. You may also be entitled to workers compensation not enough info from what is here..it is 50/50 fault so your ..50% at fault.. sorry your badly hurt but that is what i read.. you caused the accident as much as the other.. good example.. is..what i read..your leaving your vehicle..and traffic is moving..and you get hit.. that is the way i read it..and yea.. you entered into traffic..to leave your car.. why do you expect traffic to stop??? maybe when you feel better you can be clearer sorry.. that is what i read..you left your car..and expected traffic moving at the regular speed to stop.. nope...sorry your hurt...but that is what i see.. you walked into traffic..and unless your superman.. traffic isn't going to stop.. |
