If your lawyer lost a case he can stll do demand for fees and expensive? |
hi i just want to know if a lawyer lost a case he can still ask for you for fees and expensive in ontario Depends on the agreement when he took your case. If he took it on a contingency basis, ie, he agreed up front that he won't charge you if he doesn't win, but if he DOES win, he gets paid a percentage of the money he got for you, then no. Otherwise, if he bills by the hour plus expenses, you pay regardless of the outcome. I'm sure he told you up front how he was expecting to be paid! You probably signed something, too. Yes...Unless it was specified in a retainer that his only fee (pay) are a percentage of the awarded settlement...like in personal injury claims. ===================== it depends on what your agreement was when you met him...ususally yes... Before starting a case,he has to explain to you that if you lose the case you still have to pay the fees yes,but if he tells you that if you don't win the case,you don't have to pay.You have to have a document before starting the case stating that you don't have to pay if you don't win the case.
