Can personal liablity insurance on a home be used in a lawsuit if no inury occured? |
Civil case against an owner and was wanting to use the home owner policy to get payment It depends on the causes of the lawsuit and the terms of the policy contract. If it is related to something covered under the homeowner's policy (such as a slip and fall on the property) then the HO policy will apply. However, something like an auto accident is not covered under standard homeowner's policies (unless you have an umbrella policy or amendment to your HO policy to cover it). So, the moral is: the only way to know is to see a copy of the policy. Possibly! Some homeowners policies cover libel and slander, if they are not business related. It will depend on 1. the nature of the lawsuit and 2. the homeowners policy. You're best off reporting it to the insurance company, to see if they defend you.
