Which state to file unemployment claim? |
I was terminated from my job & plan to file to unemployment, however am not sure which state I need to apply with. I live in Illinois, however the job I was employed with was in Missouri & I have not had any employment in Illinois since April of 2006. Do I apply for unemployment in Illinois or Missouri? File in MO - UI charges go against the employer's account, so you file in the state in which your employer resides. Good luck. I believe you need to file wherever you reside. When you file they will ask about your past employment and where it was. But since you live in Illinois that's is the state that should be paying your unemployment benefits. Did your previous employer withhold state income tax for you under Missouri or Illinois? Technically, you need to file for unemployment in the state in which your previous employer paid unemployment taxes for you. I would bet that where they withheld state income taxes, they also paid unemployment taxes. Start by calling your local unemployment office and see if your previous employer paid taxes in Illinois. If yes, get instructions how to file locally. Otherwise you will need to go to Missouri to file. Good luck. 10+ years in HR, including payroll and taxes (fed/state/local/unemployment) I am pretty sure you would file in the state you worked in the previous 12 months because that is the job you would be drawing compensation on. I live in Alabama, worked in Tennessee, and had to draw from Tennessee. |
