Can and employer ask a former employer about your work schedule or wages? In some areas, they can give the dates of employment and last known wage if they have a signed release for information. However, it is not good to lie about it to a current/potential employer. If you were making a lot more or less, this may not impact on your current wage. You can ask anything. It's what your former employer is ALLOWED to answer by law that is more important. The former employer can open himself up to some costly lawsuits if he reveals too much to such an inquiry. If your current employer acts on information that negatively impacts YOU, in any way, you can sue the former employer for passing on confidential information. Most employers, and Human Resources people limit their responses to these kinds of background checks to the dates of employment and little else. Depends on the state in which you live, the laws vary. In our state unless you have asked the previous employer for a reference they can only give the dates of employment and nothing else. They can ask anything they wish. Most companies will verify your title, position held, dates of employment, and wages only. The only information that they have to legally give is your dates of employment. As someone said above me, it is illegal for them to say much more. |
