Is there anyway to remove a felony from your record? |
I have a brother who was charged with a felony over a white collar crime about 5 years ago, spent a year in prison. He's married and has two children...owns his own home...typical suburb household, but he can't get a decent job because of the felony charge. Is there anything he can do to get it off his record or not have to list it on a job application? From what I know, he shouldn't even put that information on the application, he should save that bit of info. for when he has the personal interview so he can express and describe the situation and the circumstances in his own words. The only thing he can really do is go back to court, speak to the judge, and ask for his felony to be expunged, which will probably end up being dropped to a misdemeanor, if he does get it approved by the judge. It's better than having a felony show up on your record or personal report. I think he'll have to wait 7-10 years before he can request to have it completely removed from his record. Source(s): me Maybe, the process is called expungement. You petition the court to have them remove it from your records. You have to meet certain criteria like it can only be your first offense, a certain amount of time has passed, and it cannot be a sexual offense. I would contact the criminal court clerk and ask him or her if it is offered. You can also research your states statutes or your states federal statutes depending on where he was convicted in state or fed court and see what is available and if your brother qualifies for it. You can also request a pardon. For state offenses you ask the Governer and for Federal you ask the President. Hi! I'm sorry, but unless you get a pardon from the Government or President, the felony sticks for life. That's one of the problems. And the stigma that goes with it is for life. My SO is an attorney and that is the law. Also by law he has to answer Yes on any application or he can be fined and that will make things worse. Please have him write next to it, "with explanation at interview", or "can explain please" and that might cause enough curiosity to get the interview. That's the best he can do next to starting his own business. If he doesn't list it on the job app and then it shows up later in a background check, he will be disqualified from employment with that firm. If he does admit to it, he will probably be disqualified anyway. It is very difficult for convicted felons to find work - there are so many questions to that respect on this board. He may want to check with the state unemployment office - some states offer training programs or other assistance to former felons. Good luck. |
