A Disability/Age discrimination lawsuit for wrongful termination is filed!?

What costs and monies items should be included for a final settlement (such as Cobra payments, bills, etc)?

Any assistance is appreciated!!!

Depends on what level you are. In Illinois we call the first level when a person files a discrimination Complaint with the EEOC/state's Human Rights Dept the "Agency Level". At the Agency Level there are rules as to what a person can request for a settlement. Generally, the amount requested is a reimbursement of salary lost, benefits lost, Cobra payments and other bills which would have been covered if the employee had remained employed, plus a reimbursement of legal fees.

If you are in the next step, which is a suit in Federal Court your attorney can advise you about adding an amount for pain and suffering to getting a full reimbursement, IF that particular court allows such an award. Most Federal Courts have a broader leeway in settlements than at the Agency Level, however, the court you are filing with may have its own restrictions. Your attorney will be able to help you with this.
