What costs and monies items should be included for a final settlement (such as Cobra payments, bills, etc)?

Depends on what level you are. In Illinois we call the first level when a person files a discrimination Complaint with the EEOC/state's Human Rights Dept the "Agency Level". At the Agency Level there are rules as to what a person can request for a settlement. Generally, the amount requested is a reimbursement of salary lost, benefits lost, Cobra payments and other bills which would have been covered if the employee had remained employed, plus a reimbursement of legal fees.
If you are in the next step, which is a suit in Federal Court your attorney can advise you about adding an amount for pain and suffering to getting a full reimbursement, IF that particular court allows such an award. Most Federal Courts have a broader leeway in settlements than at the Agency Level, however, the court you are filing with may have its own restrictions.
