Can I be arrested for having smoked pot if I fail the drug test? |
I'm looking for a new job and I decided this after smoking a joint this past week with a friend. At this new job, after you're interviewed and considered for employment, you have to pass a drug test. If I fail this drug test, could I be arrested? I mean, while I want the job, the risk of failing and being arrested isn't worth it. If I'm not arrested, what happens? I just don't get the job, I presume? No, the information cannot be used for legal purposes in terms of being charged with a formal crime. Some time ago, people tried to pull the fast one that since you're positive for XYZ, it's considered possession because it's inside your body. Supreme Courts have been overturning that one for some time now each time it comes up. no ur not arrested. but if u no ur going to drop dirty whats the point in even applying 4 the job until u get clean? the employer is not a police agency, if you "fail" the drug test you simply wont get the job you applied or. Lesson learned, STOP smoking dope. good luck If they are requiring a drug test, then the odds are that you won't get the job. It is highly unlikely that you would ever get arrested after failing a drug test, though it is illegal, they would just pass you over for employment No, you will not be arrested, however, I would not take the drug test and make up some excuse if you know that you will fail it. Just tell them that you are no longer interested in the job....ANYTHING is better than asking to delay a drug test , which every HR person knows is a red flag. That can bar you from every seeking employment with that company in the future, or any of it's subsidiaries. Don't make the mistake of getting a kit from the drugstore that claims to make you "test clean". They are full of nitrates and today's tests test for nitrates and it's an automatic fail. This is why you should not smoke pot or do drugs. You're obviously paranoid. If you take drug test and fail it, you will not be arrested. Of course, you probably won't get the job either. The only way you can be arrested on drug charges is if you're in possession of drugs and/or drug paraphernalia. You can also be arrested for being too high or intoxicated. The people who administer the drug test for this potential new employer are not law enforcement. They are just a company who have been contracted to provide laboratory services. |
