Please Help about Company Laws? |
Friends i want to know that " wat is the minimum number of holidays in a month that an employee can have in a private office?" are these different numbers in different offices? or there are equal numbers of holidays in all private offices in INDIA????? Your question need to be segregated for better understanding. First of all, your question has nothing to do with the provisions of the Company Laws in India. Secondly, we can differentiate between holidays and leave. For holidays, they are broadly governed by the State Administration for their respective States - both for public and private offices. Again, Central Government has different set of holidays for its employees across the country keeping in view each States' religious, cultural and administrative following. Broadly, both the Central and State Governments extend 18-20 Annual holidays (Gazetted and Restricted) for each of its employees besides the Earned/Casual/Medical leave. All national holidays (3 in number as on date) remains compulsory, rest may vary among the States. All these holidays may also fall on already weekly offs or any other holiday on the same day. For leave - (earned/casual/Medical) over and above the above holidays, each State and Union Territories have their own set of Labour Laws/Office and Establishment rules which are enforced throughout the respective State. Both for holidays and leave entitlements of the employees of the government and private sector, there are "certain" exemptions to private sector to formulate their own rules, meant to be applicable in the organisation's all offices/place of work in the State uniformally. Yet certain holidays must be followed even by the private offices - national holidays, State's Day, major festivals followed in a particular State. For the private sector, there are provisions to offer compensation in lieu of - in the form of cash or compensatory holidays. For private sector, each office/place of work is supposed to make open for all its employees the days that would be followed as holidays in any current year - in the beginning of each year itself, and the leaves are governed by the respective company rules for their employees as operational from time-to-time. In the United States there are varying holidays. However, it is up to the business / company you work for to decide what holidays will be observed. Can't answer about India specifically. --------------------- Go to your human resource department and request a copy of your companies handbook, and any other amendments or additional information available about time off (including sick time, vacation time, and holidays) -- You need to seek your companies policies and procedures. Keep in mind all companies vary. No one here can answer what you are asking. However, your own company can, in fact, supply you with the answer you seek. it is mandatory for every company or offce to close it on the days declered as holiday by the concerned authorities/states as shown in the list of gazzeted holidays.company may run their unit with the advance approval from the concerned authorities. The holidays are governed by the various laws such as Factories Act, Minimum wages Act etc. and also the rules and regulations of individual companies. National holidays declared by the Government (Independence day, republic day etc) are compulsory and other festival holidays are clubbed in restricted holidays.... |
