Fired unfairly what can I do? Dear CATLAW, discrimination, is not the only legal issue that can be presented by a plaintiff in a wrongfull termination cause-of-action. A Plaintiff can also prevail if they can prove that their termination went against "Public Policy" there are several examples as to what constitutes "Public Policy". Source(s): of and on Paralegal. In nearly all states unless you had an employment contract, you can be fired for any reason except for a protected class like race, sex, age, religion, etc. If you are NOT under a Union or Employment contract, you are considered an 'at will' employee. At will employees can be fired for anything EXCEPT discrimination. Look at www.eeoc.gov for what the courts considered to be discrimination. As a judge once told me "unfair is not always illegal".
