I got fired?



i got fired a couple of weeks ago. I was in a "union" and i was fired because of "Insubordination" But every single "GUY" that ever was insubordinate just got either a "Write Up" or just a suspension.I felt "wrongfully discharged" because of that.I should of least got another chance. My union representative is trying to get my job back. He told me that the might offer me some money so they don't have to hire me back. He mentioned $5,000,I really dont think its worth it but i dont know what i should do. or what might happen. Any Opinions?

you union rep will get you an arbitration for your case and all they have to do is show similar cases where lesser discipline was handed out for the same offence.

Its pretty much open and shut. If they can show that others recieved less for the same thing the arbitrator will rule to give you the same punishment. you should get back pay for all the time you are off less the suspension days (if any) you are given at the arbitration.

ie: it takes 9 months for you to get your job back and the arbitrator rules on a 5 day suspension you would get 9 months back pay minus 5 days. If you earn money at another job during this time off they will deduct that from the back pay. so lets say 9 months -5 days is $17k and you worked during the 9 months and made $7k you would get $10k in back pay.

stay on your union rep it's his job to do this for you. This is why you pay your union dues. he is talking about you taking the 5k becuase it makes his job easier, make him take it to arbitration if you can show the same thing happend without termination. but also if your insubordination was way diffrent than the others you might be stuck. I means if they other guy refused to do something and you told the boss you were goin to kick his *** and told him to f-off you might not win. the cases must be similar

if he refused to take it to the right steps go over his head to the union officials at their headquarters

and if you dont want to go back still push arbitration becuase their offer to buy you off will go up. Source(s): 7 years as cheif union steward for the sheriff's department I worked for I handled 100's of these cases

I suppose one question to ask yourself is, do you really want to go back to work for a bunch of sexists? This is heartbreaking to hear because it does happen and look what happens, the guys *white* I'm assuming gets nothing and all of a sudden a lady messes up once and she's a problem. This is the ***-backwards crap that is our buineness world. Sorry about the rant, I personally don't think 5k is going to be really worth it but if you have to take the money and run...then stay in contact with your union and perhaps try to search for another firm, I'm not too sure on your job title right now, but I'm feeling for you right now. The problem is we are in a bit of a recession and I too am having troubles with locating a job, good luck miss and thats my thought on this issue.
If you get rehired then things may not be pleasant at the job for you. Take the money and meanwhile you should be looking for something else.
