Leave rules in private limited company in India...? |
The private limited company where I work as accounts assistant has " No leave " policy/rules. It means we get only Sundays as holiday and no other leave is granted. Is it legal? What is the legal position of leave rules for employees of a private limited company and how can it be enforced??? If I go by your version simplicitor about your employer, it is indeed an exploitation. Employees, individually and collectively, do have recourse and options to make it work for them. Since you haven't mentioned your place of work, I can only suggest you broader options. Just the structure of the business as a private limited company, thereby, company law provisions and rules don't have any say in this aspect. You will have to bank upon the local labour laws and Establishment Act (read Shops & Establishment Act and rules made there under for your territory) to begin with - in case the management of the company doesn't take care of these aspects. Differentiate between holidays and leave. Both are different in nature and benefits. Next, look for the compensatory provisions in lieu of the holidays and/or leave being practised in your company. Talk to the management first, collectively if possible, and if the management doesn't come forward with an acceptable solution within reasonable time, seek the assistance of local labour office and/or municipal/administrative government authorities taking care of establishment issues in your area. Finally, if nothing works, you may sue the company in a court of law under appropriate legislation in consultation with a good local lawyer. |
