Can a former employer make negative comments? |
my former employer has made comments to people outside the company that include kicking my ***, that I was unprofessional etc. these comments were made to potential customers in my new job. Is this unprofessional or just childish revenge for my changing jobs? Plus what information can a former employer release to a potential employer? thank you for any help I can get. normally an employer only verifies your name , job title, department, dates of employment and if the employee is eligible for rehire. an example of someone that is not eligible to rehire might be someone who falsified their expense reports . Depending on what the comments were, there is a possibility of a suit for Libel, however. Any employer CAN release any truthful information to a future employer. However, it is customary to not do more than verify dates and wages. This is because any employee CAN file a suit against a former employer. Depending on your state laws, his comments may be considered illegal. In Illinois a law was passed in 1997 that allows employers to say what they want, as long as the employer believes it it true and it is in response to questions asked. Which means that the employer can spew any vile lie that he wants. Other states restrict what former employers can say in a job reference query. In order to prove that law is violated you would need to have the testimony of someone asking for a job reference. Sounds like your former employer is aware of the law and is making comments that are outside what the law covers. Yes, it is childish revenge because you had the courage to get out from under his control. I have always found that a few prepared comments are better at getting back at a former employer and are less costly than suing them. Next time you hear about a comment from him, looked shocked and say something like 'poor man, he must be off his med again" and laugh it off.
