How many days in a row can an employer mandate an exempt employee to work? (California)? |
I am an exempt empolyee working monday thru Friday in California. My employer has mandated we work Sept. 22nd and 23rd. This would be 12 continuous mandatory days of work. Is this legal? What is the legal amount of days an employer can mandate you work? When you are exempt there is no limit, depends on the company's needs at the time, remember you also get paid on the days you call in sick and have less than 40 hours. Just willing to bet if you where hourly and the days where time and a half, followed by doubletime there would be no problem with the twelve in a row? Sorry thats the life of salary I don't know why anyone (except the submitter himself) would chose this as the best answer. I certainly did NOT chose this and do NOT deem it to be the best answer. I deem it to be the worst and most rude. There are limitations for non-exempt employees, but not any for exempt employees. However, if they have ever docked your pay for missing less than a full day of work, they are in violation of the exempt status -- you may be able to do something there. Since this is apparently a one time thing, I wouldn't worry too much about it, unless you had previous plans -- and then see if you can get an exemption by doing something else. Yeah, that's the fun part of being an exempt employee - you are exempt from overtime regulations, which means that you are basically "on the clock" 24/7. Your employer can ask you to work 12, 30, or 150 days in a row without legal consequences. Sorry....tell them you at least expect free lunches both days for having to work all weekend. :( I tried to look up - mandated work - exempt employee- google wants to know what your county is. I am sure you can find the information you want if you search. |
