Must I compensate for backing out??



I've recently backed out an employment which has not commenced yet but I have signed the offer letter. Now, the company is asking me for compensation of 1 month's salary.

I've gone thru the letter many times but there's nothing that stated that I have to compensate in the event of me terminating the contract, The only related term is that i have to give a month's notice for termination (the usual).

i thought it was out of courtesy that I inform before hand of my situation (I was requested to stay in current co. due to internal reasons thus I can't resign). Could someone advise me on this? Anybody who had encounter the same thing or any lawyers around to advise me is it right for me to ignore such compensations?

Not a lawyer, but I don't think they can collect, especially if you informed them more than one month before your start date.

The letter might say you have to give a month's notice, but it doesn't specify what happens if you don't. Makes it really hard for them to enforce a provision that isn't clearly spelled out in your contract (the offer letter).
