Can an employee who is leaving ask to see the reference we have given them? |
Can an employee who is leaving ask to see the reference we have given them? I dont know about that but why wouldnt you want them to see it anyway. Is it a bad reference cos you're not allowed to give a bad reference. You can refuse to give a reference but you cant give a bad one. you know you cant give a bad reference by law, you are only allowed to point out the possitives about the person even if they are scum! so what does it matter! when i left, my new employer showed me the reference from the old one.. the new one found it quite funny and petty as i had left the after 10 years.... i dont think you need to show it them.. you can refuse.. Employees are entitled under the data protection to see anything you have written down about them, this includes references, you can get around this by saying that you are happy to give a reference over the phone to any potential new employers. there are so many laws to protect employees but very few for employers. experience To answer your question - The reference is written under private and confidential to the person/company that requested a reference about you it is therefore for that person/company only, therefore you cannot ask to see it before them - if they allow you to that is a different matter.. Whilst people are telling you that you can't give a bad reference it is perfectly in order to highlight the bad points, eg "when Mr Jones eventually arrives in the mornings his work is quite acceptable", and I have also refused to give a reference on a dishonest employee who was sacked - which gives the indication that something was not right. I have also bent the truth a little on staff who tried really hard but were not up to the job - by praising the amount of effort they put in rather than their skill.
