Is it legal for an employer to refuse time & a half payment when an employee works over 40hours a week?



my employer does not allow us breaks or lunch breaks because we work one man shifts, nor do we get sick days, vacation pay or insurance and we are all full time employees. Is this illegal or just unethical?

I think its legal now and you can thank Bush for that.
In certain jobs such as a security guard taking a break or a lunch is not always an option , as far as sick days , vacation pay and insurance are concerned its just unethical , as far as working past 40 hours in a week gos overtime is mandatory in all states I think , check with the state about employee rights. You didn't say if you are paying taxes out of each check or if he is sending out a 1099 at the end of the year which would essentially make you self employed and none of the above would apply.
If you are a "non-exempt" employee, the employer must pay time-and-a-half when you are required to work over 40 hours in a week.

Lots of exempt, salaried employees (including the President of the U.S.) receive the same pay regardless of how many hours they work, sometimes over 100 hours in a week, without any extra pay.
it is unlawful to be full time employees without getting some type of brake ( at lease here in oklahoma) if i was you i would talk to a lawyer and see what i can do about suing...
turn this company into the labor board. don't delay. file this complaint anonymous.
It depends on whether your job is "exempt" or not. If so (most of these jobs are salaried) they can do it. Most but not all hourly employees are required to get overtime after 40 hours.
Sick, vacation pay or insurance is not a requirement...sounds like you should look for a new job.
