I have given my mother in law a job? |
i told here to give one weeks notice where she works now but her boss has told her a month she has only been there 1 year and gets basic wage. so my question is he can't make her work a months notice can he? Yes Yes. Unless you are prepared to make up any money she could lose by leaving after a week , she will have to work the full month too. He can't make her do anything but you can bet your life he'll hold back her money just to make things difficult, maybe she should leave right away and just put the loss of wages down to experience. Good luck If a month's notice is in her contract then yes, she has to work that or she will be in breach of contract. The answer to your questions depends upon variables you haven't stated - where did this happen (U.S.A.? What state?); did she have a written employment agreement? what is the time period between paychecks? Without this basic information, any answer is merely guessing - even by a professional. BUT having said that, generally a minimum wage employee need only give one pay period notice of intent to leave (and only then to avoid losing the last paycheck). If there is no written agreement, nothing stops the employee from quitting without notice at all (but she may lose her last few days pay for doing so). Retired Texas trial lawyer a contracts a contract, if her contract of employment states she must give 4 weeks notice then thats what she should do if she elects not to honour that contract then the employer is at liberty to withold payments, and arguably sue for breach of contract. lets face it how would you like it as an employer if one of your employees decides to walk out at short notice, potentially leaving you in the lurch in flagrant breach of contract. owuld you accept it it, or would you insist that your employee honours the contract or seek to recover some of your costs. I'm not saying its comparable, but I'm aware of someone who got a job on a fake CV & good interview, after 3 weeks in work her new employers sacked her for deceit, then succesfully sued her for the contingent losses arises out of them recruiting her based on a fake CV.. it cost her some 拢25,000.. admittedly not in this country... most of that cost was the cost of hiring in temporary cover for the post whilst they tried to recruit a replacement |
