Is it legal to decrease someone's pay even if they weren't demoted or no change in job responsibilities? |
Well this would be my third week working for this company and they told me that my pay would go down to minimum wage because the company regularly doesn't pay my position as much as I'm making now but when i was hired no one had told me this and I've already had gotten paid the week before. My job responsibilities haven't change and i was demoted so i just want to know if its legal for a company 2 do this in New York? Call your local labor board. I know when our company got taken over by a new company, everyone took a pay cut. But to do that the way you said sounds very wrong. Good luck. In most cases it isn't illegal. companies usually cut back benefits and bonuses instead when they want to save money. However it is a good reason to quit because they've changed the agreement when you were hired. The only time it might be illegal is if they put your wage in writing if they gave you a contract when you were hired. Unless you are covered by a bargaining agreement, like through a union, an employer can change your pay or pay dates anytime they want to. It sounds to me like they don't like your work. Start looking for another job as I doubt you will be happy there anymore. Good luck 15+ years hiring & management No way is that legal. I live in NY as well. Don't let them do it. Tell them you will go to the better business bureau. And then find a job that pays more then min wage. Go be a food runner or wait tables somewhere. You'll make upwards of $10 an hour even as a bus boy. David I am shocked. If you were in the UK I'd say go to your nearest Citizens Advice Centre. They are brilliant & know all the answers & more important where to get expert help. There is bound to be an equivalent in New York.. If it were me I would do this the advice is FREE.. Here in the UK employers such are yours can be taken to a employment tribunal & if found to be in the wrong MUST pay compensation/& back dated wages. I'd also be looking for another job. My faith in human nature is still good. There are some people in our world who care & I'd rather spend my time with them whether at work or play.. You show others respect in life you get it back in spades.. & the opposite is also true... what goes around comes around.. your employers are playing a dodgy & very sad game.. you might well have the last laugh. They don't deserve good employees. I'd check with the Labor Law Agency in your state, sounds fishy to me. You were demoted yet doing the same job and it is only three weeks? |
