The General Manager leaves while on the clock.?



Ok, so My GM leave work while on the clock. he gets paid to do what ever he is doing. NOT WORK. then whites him self out the next day. or comes in later and clocks out. He is hourly because he was never around when on Salery. Is this Legal in California? if its not where would I find it in writing?

You can terminate him with no legal repercussions. He is leaving the work premises and you are paying for this time. I suggest you begin writing him up (warning notices.) California has some pretty awesome employment laws that favor the employee and it is for this reason you must be diligent in documenting everything. After giving him the warning make sure he signs off on it. If he refuses to sign it then on the bottom of the warning write "refused to sign" with date and time of meeting (i.e., Thursday, August 30, 2007 4:58pm.) There is nothing illegal or on the books regarding his work eithic being illegal, but again, you have every right to terminate him and I suggest you begin documenting this immediately. The warning notices should be as follows:

1 - Verbal warning (put in writing)

2 - Written warning

3 - Final written warning if the behavior continues he will be terminated.

Or you can do 1 verbal and two written warnings and the 4th warning would be final warning.
A General Manager is usually salaried and OFTEN works more than a 40 hr week... Even if he is hourly you have no idea what he is doing when he leaves..may be going to a meeting with the owner, accountant, bank etc. while you assume he is going home .. it's none of your business to watch his time..if he is not doing the job the owner will eventually fire him. GM's often work a lot more than 40 hrs a week .. you may not be aware of everything he is doing ..so mind your own business and do your job!!
exactly, he gets paid to do whatever he's doing. you get paid to do whatever you're doing. so worry about what you're donig, and less about what your gm is doing, and all will be well.
Suggestion, mind your own business BEFORE you learn the hard way.

You have no idea what his arrangement is with higher up and it may be he has permission to do as he does, then who has egg on their face?
Ofcourse not!
