Is this against employee rights? Do I have any rights? Is there anything I can do?



I currently work for my families company, my father-in-law is the owner. Within the past 8 months he has taken a more laid back position in the company and has hired some other key people to step in and take over some of his duties. One of th people he hired is determined on let the majority of the current employees, including me, and bringing on people she has worked with before. Through a trusted source in the office I found out that the person I am being replaced by is her son's girlfriend who does not have the same knowledge and experience I have. The reasons the source has told me that they are going to let me go is that I have messed up a couple of things, but that they could not remember specifics. And another reason is that I had missed time due to my daughter getting kicked out of daycare. When I did miss time I made it up and always put in my 40 hours for the week. Also, I have never been written up or disciplined for the reasons they stated I was going to be let go.

Most states are "work at will" (also called "right to work") states. That means that, absent a contract specifically stating otherwise, either the employer OR the employee is allowed to dissolve or terminate the working arrangement at any time, for any reason, other than those specified by law as being protected. Everything you have spelled out in your question indicates no type of protected class applying to you, so unfortunately, your new supervisor probably can terminate you. Sorry!

You may find it worthwhile, however, to consult a labor attorney or your local state labor commission to arrange the most favorable severance package you can. Or, you could appeal directly to your father-in-law to override his new employee's decisions. But absent him stepping in, there is probably very little the law can do to save your job or prevent your termination.

Tell him you are getting let go so that her son's girlfriend
can you replace you and would he write you a letter of
recommendation and possibly would he have any job leads
for you.
unfortunatley, any company has the right to terminate you @ anytime, unless its because of your race or, gender, age, or relious beliefs, in most states, like cali. unless you can prove those above, sorry honey. sucks i know. i had a company fire me when they found out i was pregnent and tryed to say it was because i was late a couple of times, but i knew why, but i couldnt prove, i felt like a sucker.
If they have the power, they can do whatever they want. You should talk to your Father-in-Law, or better yet, let your Wife do it.

Most companies do not really need a reason to let you go, although to avoid increases in unemployment insurance rates, they have to have a legitimate reason to fire you.
It may be time to talk to the father-in-law. It will definitely be in your favor if other employees that he respects and have been with him for awhile have noticed this too. If anything it will give him a heads up on where his business could be heading if he does not keep an eye on it.
I'd explain this to my father-in-law, but if he refuses to intervene there isn't much you can do. This type of favoritism is pretty common.
