In CA, is it acceptable before the law that the employer fires the employee who is 66 of age? |
I know of someone who has been working for this private institution for about 8 years, is a good worker, healthy and able to do his duties. He is questioning if his employer has the right to fire him just because he is 66 and can now apply for SS benefits. Thank you for your answers. Tell him to contact a Attorney: It would be Age Discrimination private insitution, no problem Your age doesn't exlude you from a good firing, at least not where I'm from. Ask him why he wanted to get fired. I can make up any excuse I want to fire someone. If need be I'll just have him whacked. It almost certainly is not. Discrimination on a number of grounds is prohibited by law, and I am pretty sure that age is one of them. The labor law protects the elderly. Have him get a written reason for the termination. It is likely he was terminated for a cause that he just does not want to talk about. No employer in Ca. want to get involved in a discrimination case. federal law mandates that a person cannot be fired for age, race, sexual orientation, physical disability and a slew of other things. Could just come down to they dont need him anymore. or they can get someone to do his job for less. Or someone who needs equal opportunity needs his position. |
