How can I tell if I was terminated or laid-off from my job.? |
After a disagreement at work (non-violent) I was notified by the owner via email that they were "unsure if they would have hours to offer me in the future." Never giving me an oppurtunity to respond or even relay my opinions or perception of the situation. You were terminated. Here is what it means to be laid off. Lets say your employer laid you off. Usually it is because they are downsizing due to money problem, or, because they deem the position is no longer needed. So basically, it is no fault of your own. Since you had a disagreement then it is the reason of why they terminated you. Lets say your job title is A. After you get laid off the employer is not allowed to fill the A position with anybody else but you. Unless, they ask you to take the job back and you refuse. Or, the time limit has passed (different states have different time limit). If the time limit at your state is 2 years then after 2 years they will be able to fill the position with somebody else without your permission. you don't put enough information in your question.i think you got terminated. lack of hours would be considered layed off. Continue to work as it doesnt quite say you are no longer working there. If they call the cops when you show up - then you were terminated. FYI. At my company we had a worker quit, then filed for unemployment. She was approved for unemployment because she stated she quit because of a hostile work enviorment. Unemployment office agreed. Most companies do not have to give you any reason for letting you go. Most states are "at will" employment states - meaning they can hire and fire at will with no reasons. They are gently telling you that you have been,, in other words, fired. |
