California overtime laws???? |
If I work 3 12hr shifts in a row, I know that gives me 24 regular hours and 12 overtime hours, do I count the 12 overtime hours towards my 40 hjour week? So if I work 4 hours the next day (same week) am I at the 40hrs? Or do I have to work 40 regular hours to meet my anytime after 40 overtime rule? Only hours worked at straight-time apply to the weekly 40-hour limit. This prevents 鈥減yramiding鈥?of overtime, where an employee earns overtime on top of overtime already paid. When calculating overtime pay, you must use the employee鈥檚 鈥渞egular rate鈥?of pay, not the normal hourly amount. Example: An employee works 10 hours each day Monday through Thursday, and therefore is owed eight hours of straight-time and two hours of overtime for each of those days. When that employee comes in on Friday morning, although he/she actually has worked 40 hours already in the workweek, he/she has worked only 32 hours of straight-time and does not begin earning weekly overtime until he/she works eight more hours. Source(s): California Chamber of Commerce (www.hrcalifornia.com) According to California Law, anything after 80hrs is considered overtime.So lets say, you worked overtime on monday for 4hrs and tuesday for 4hrs, but you called in sick on wednesday, those 8 hrs of overtime are going to cover that sick day turning the overtime hours into normal hours... It depends on your company policy. What your hire on agreement was. Such as when do overtime hours start. Working 3/12hr shifts usually adds up to 36 Reg. Hrs.The additional 4hrs + a40hr.week. That is if overtime does not strart after any 8hr. shift. If it by policy or Law does then you will have gained 12 overtime hrs., 4 @ a time on eachm 12 hr. shift. Again all of this depends on your hire on agreement. If you agreed to work-3/12s & 1/4, overtime does not seem to apply. |
