What are the legal steps to do when your work place accused you of stealing or of something that you didnot do |
suppose the owner of the restaurant that i work accused me stealing and saying that everybody told her that i did and when i confront them and they all denied Let him know you want an want an attorney. The first thing you should do if the owner confronts you about stealing is to tell the owner to call the police. If the owner can prove that you stole something, then the proper action for the owner is to call the police. Chances are if the owner has no proof, he will never call the police. If the owner is foolish enough to try to accuse you of theft and report it to the police with no proof, it further bolsters your civil claim against the owner. Second, talk to a lawyer. Accusing you of theft, particularly if the owner has shared these accusations with your co-workers, you have a decent case for defamation. put everything in writing. all companies are required by law to go thru due process, that is, hearing the employees side first before they can decide the proper sanction or act on the case. companies usually issue warnings or notice of explanation to which you should be able to submit in writing an incident report within 48 or 72 hours im not sure. in any case just put all the facts on paper and make sure you have a receiving copy duly received by your company representative. hope this helps It depends on your state. Some it is considered "at will work state" meaning they can fire you for any reason. And if not you can file a grievance with either the owners or the regional level.. if not just go somewhere else... there will always be people like this.. If it goes further... don't say anything! Ask for the right to legal council... its worth it!!! They need to prove it or you sue,,,period. |
