Legal Questions For Working In A Restaurant?



I work in a restaurant and I was wondering if it is legal for my boss to tell us servers that we have to pay for the check if we have a dine-n-dasher? We, as a staff, are very upset over this and need to know if it is legal or not....

Do you have a cashier?? Does the guest walk by the cashier on the way out?? Why should the cashier then not be 50% responsible? It is EVERYONE'S job to be on the lookout for dash-n-diners. Check with your local Labor Board or call your resturant's home office or talk to the Asst. Manager. All resturants have a food cost overage. Source(s): Over 15 years experience in the food industry.
This is regulated by your state's laws. I don't know of any state that allows deductions from paychecks that are not ordered by a court or volunteered by the employee (such as medical premiums). Some employers think as long as the employee "says it is ok" then it is okay to do it (like paying back an advance or something through payroll deductions) but as an HR manager I wouldn't do it - it can come back to bite you. Do not take your boss's word or edict on this. You report this to the Labor Department in your State. You are entitled to your standard hourly wage on the job. What you stand to lose of course if a diner skips out on a bill is the tip that you would otherwise be entitled to if that diner paid and left a tip.

Your boss is breaking the law if this is the USA. Even if he or she had undocumented workers in the restaurant, that would be illegal.
