Is my boss trying to hold me back?



I have been hired at another location of my company (cross country) and now that I need to turn in my notice (2 weeks) my current boss is telling me that he wants 30-40 days.
The new position (promotion) will not wait that long, they have already pass me up for another position due to my boss wanting too many days notice.
Is this something that I should talk to an atty about?
I feel like I am being held back from advancing in the company, and I really want the transfer.

there is absolutely no law that says that an employee needs to wait 30-40 days before quitting, your boss is just looking out for himself...give your two weeks and leave...as long as you put in your two weeks you are good to go.
How awful! What kind of boss would do such a thing? I would check out your company policy on giving notice.....but also talk to the HR people (or supervisor) of the location you are moving to. Tell them the situation, and see what they say about you leaving your old position earlier than what your boss is asking for.

I guess basically, you would want to know if they would go ahead and hire you regardless of what your current boss does if you should leave early.
Will you just working out a 2 weeks with your current bos cause you to loss the new job offer? If not, then screw your current boss and move on, if so, then I would talk with someone in HR with your company to find out what options you have. There are no legal parameters on working out a notice, although the standard is 2 weeks notice. Go to you Human Resources Department withing your own company. Let them get involved in this, and give them first crack at resolving the issue, if then they don't resolve it, then seek legal advice. If you go to an attorney first, then it may cause further conflict withing the company. Good luck, but it does sound like you current boss doesn't want to lose you, meaning you way to valuable to him. I have known other managers that did the same thing, they were afraid or just lazy and didn't want to deal with the change.
What happens if you just leave after 2 weeks and take the new job, whether your old boss likes it or not? What can he do? Fire you? You are leaving anyway.
Go to the Human Relations department and ask for their help.

They know company policy both written and unwritten better than you do. They may have the authority to overrule your present boss or get someone else higher up in the corporate structure to do so.

If everything else fails ask HR if you can quit and then be rehired without any loss of seniority salary so that you may get to the new job on time.

Bosses should want to see their employees advance and not attempt to hold them back.

Notice is a professional courtesy, not a legal requirement. Your manager is being unreasonable. Check with your HR department on the internal transfer policies that apply -they may be able to assist you with this.
