Is there a such thing as improper training on a job when a person get huart and If there is under what law ? |
I was hurt on the job, what law in the law book can I look up and find a case that will explain it to me If you got hurt on the job you need to find out if your company has Workers Compensation large companies of 10 or more employees by law has to carry it. You would have had to go to a Workers comp approved hospital to be checked out and WC pays the bills. The company will have to report to Workers Comp and they will write down what happened in order for you to get hurt. If you are seriously injured you need to report it. I thought I had broken my finger when the roof hatch of my building smashed my hand (I was a property manager and was going up on the roof to inspect the AC unit of a tenant) I called the corp office and told them I was injured and had to go to the hospital, they told me which one to go to and I filed a WC claim thru them. Notify your employer. Workplace safety is mostly overseen by the Occupational Safety and Health Administration (OSHA.) some states, such as CA, have a state version of OSHA as well. Worker's compensation is the part of the safety codes that deal with employees who injure themselves or become ill at work. Work comp laws vary from state to state - it's really a legal mess. You should ahve gotten paperwork from your employer when you filed your worker's comp injury report that spells out what your rights are under your state's laws. In almost every circumstance, you have the right to consult with and/or retain an attorney, the right to compensation for medical expenses incurred as a result of the injury, and the right to either return to work or be retrained by the state for a new job if you are disabled. The company should investigate any work-related accidents that occur and determine the root cause of the problem. Improper training could well be one of the causes, along with things such as poor housekeeping practices, equipment that wasn't guarded or working properly, negligence, poor first aid response, etc. You need to find out if your company has Workers Compensation. Companies with more then around 10 people are required by law to carry it. |
