So i was wrongfully fired and then rehired 3 days later, is there a law saying i should be paid? |
Or what is the best way to go about having them pay me Thanks in advance The unemployment thing mentioned above is usually only good after you have been off for two weeks -- they will pay you for the two weeks but only after the second week. If you were wrongfully fired, I would ask -- it can't hurt. But if you are an hourly employee, I would not expect anything. If you are salaried (exempt) and haven't been paid, they may not consider doing anything. But generally, if you don't work you don't get paid. Are you kidding me? You didn't work for 3 days. I think you should just ask. But don't say anything about laws or whatnot because they will just think you're a troublemaker and regret their decision to rehire you. Possibly in California , but , other states ? I'm guessing they would allow the bosses to demand a gratuity for rehiring . FYI - most work is considered "at will" unless you have a contract . No contract ? You can quit whenever you want and They can terminate because they don't like the color of your shirt . At will means . . . can be terminated at any time . For any reason and without prior notice . They just have to pay you when they pink slip you . > NO... no work, no pay.. You can file for unemployment for those 3 days. Any time your work schedule is reduced, or terminated--- and it is NOT your fault, you can file for unemployment compensation. It will be a meager amount (something like %40 of your pay) but it will help out, and it will put the authorities on to your employer about the wrongful firing. |
