Washington DC paychecks: What law requires twice-per-month paychecks? |
I have heard that, in Washington, DC, employers are required by law to pay you twice per month. But, I have searched and been unable to find the actual law. I need to know: (1) does this law, in fact, exist? And can I get the text of it online? (2) is there an exemption for small employers? (3) are there other exceptions or loopholes? Can someone point me to the text of the law? [Note: I know that the House of Representatives pays their employees only once per month, but they are in suppose exempted, as the Federal Govt. My question does not relate to this fact.] Here you go: Washington DC Code 搂 32-1302. When wages must be paid; exceptions. Every employer shall pay all wages earned to his employees at least twice during each calendar month, on regular paydays designated in advance by the employer; provided, however, that an interval of not more than 10 working days may elapse between the end of the pay period covered and the regular payday designated by the employer, except where a different period is specified in a collective agreement between an employer and a bona fide labor organization; provided further, that where, by contract or custom, an employer has paid wages at least once each calendar month, he may lawfully continue to do so. Wages shall be paid on designated paydays in lawful money of the United States, or checks on banks payable upon demand by the bank upon which drawn. You can search on DC's website (listed below) and click the DC Code link under the DC Government link. I don't see an exception for small employers and/or loopholes unless there is a collective bargaining agreement (commonly referred to as Memorandum of Understanding), but look in the Labor code (Title 32). the section I thought was appropriate was titled "CHAPTER 13. PAYMENT AND COLLECTION OF WAGES." Source(s): http://www.grc.dc.gov/grc/cwp/view.asp?a... http://weblinks.westlaw.com/find/default... Never heard any law anywhere that requires how often a person is paid. Due to the cost of payroll almost no one is paid every week anymore. |
