I have an idea and some sketchs for a product, do i need to get a patent now, and can i? |
or do i get a prototype first im a beginner but i think my idea will work any help is much appreciated Many years ago I had an invention. I developed the complete project - "soup to nuts" - (((((or so I thought.))))) I asked a few honest, knowledgeable people, "What kind of a man would I see about an invention?" (((Sorry ladies. This was in the 1960s. Times were much different then.))) Almost simultaneously they responded, "A patent attorney." One of them went a little further to suggest "Ron, you need to sit down and talk with a copyright, trademark and patent attorney." THE ONLY reason I knew to consult a patent attorney was because I asked. I went to the library to do some research (((((this was waaaay before the internet)))) to find a local patent attorney. I made the appointment and kept it. I THINK I paid a small fee OR perhaps the initial consultation was free. I'm sorry. I really don't remember. Some of the many questions he asked were, "Are you ready to start production?" I answered, "No". Is your financing arranged?鈥?br /> I answered, "No" 鈥淒o you have the money?" I don't remember if I even thought to ask, "How much do I need for my project?" If I asked, I don鈥檛 remember his answer. "Who is going to put this into production?" I didn't have an answer. The response, "I don't know." is very lame, isn't it? "Where are you going to put this into production?" I didn't have an answer. "When are you going to put this into production?" I didn't have an answer. I was told: Simply because I had sketches, a prototype and all the other invention-related components were not enough. The inventor must be able to start producing the invention almost immediately after the patent is granted. I'm not exactly sure whether this remains in effect today. Perhaps requirements changed. Perhaps other requirements were added. If I were you, I would further investigate the matter by consulting with a knowledgeable patent attorney in your area. You do not want to go to a general practice attorney. You do not want to go to a corporate attorney. You do not want to go to any other type or kind of attorney. A little common sense - enough to ask someone - just as you did here. 鈥淭HE University of Hard Knocks鈥? Call that one place...inventor something or another, they always run commercials, patents are really expensive... Anyway, most patents are indeed in the form of a blueprint. Have you seen those commercials where there is a caveman making the wheel, and they say they can help you with your idea, maybe you should call and ask questions.
