If I use a song for an AD, do I have to get permission first from the song writer before copyrighting my idea?

Yes. You need to get permission from whoever owns the copyright. If you don't they can sue to into oblivion. A song is intellectual property. It is the copyright holder's legal right to determine who can use his/her work and set a fee.

You have to remember that not all song writers want their work used in advertising. Or the copyright holder may have already sold rights to another company and your use would violate that contract. In which case two people could sue you!

Finally, before you use a song or image or anything else, you need to know if you can afford to use that work. A famous copyright holder will demand a higher price than a writer no one has heard of.
