Do you have to trademark every design you create? |
I'm starting a clothing line and still getting stuff together, and I was wondering if you MUST get every design you create trademarked or copyrighted. Like, if I trademark the name/company, will everything I create under it be trademarked? Or no? The name of your company may qualify for a trademark if it's unique and distinguishable from other names. You do not HAVE to register a trademark - registration is optional. The designs you create, will carry the label with the trademarked name on it, but the design itself will be protected by copyright. Copyright is ALWAYS automatic the moment you create something new. You only own a design if you can prove you created it and that is the purpose of registrations. Intellectual Property Law (Patents, Trademarks, Designs.....) is very specific and each of your designs will require an application to be protected. Now, it is possible that you would only want to protect designs with real value, but to enforce any rights, you must have a registration. I assume you have contact with other people in the field and you should consult with them on how they protect their ideas. You also will want to work with a credible trademark and design attorney to ensure everything is done correctly. Paying now will certainly save you more later.
