Cal/OSHA came in and cited us for a few things. Our corporate office is in Virginia. All policies and programs originate from there. For example, our Hazard Communication Program is not identical to what Cal/OSHA says needs to be in the program. It is my understanding that federal OSHA overrides state laws and regulations. So, can Cal/OSHA cite us for something that OSHA does not require us to have?
You corporate office has fallen down on the job. You must meet the most strict between the two sets of rules. State regs can not be less then federal OSHA, but they can be stricter. In California, you must meet California regs. Federal OSHA is just the minimum.

20 years in the business Your understanding is faulty. The way that it really is, I will try to explain. Federal law has to be met, also the laws from your state have to be met. If the laws were less that the Federal laws the Federal laws would need to be met but if the state laws were more stringent than the Federal laws then the State laws would need to be met. I will give you an example not the same agency but the same deal
Cars are built and sent all over the United States and must meet US Standards, how ever California has a more stringent law and cars there must meet California emissions standard. Which ever law is the greatest is the law that will be applied. Perhaps not the answer that you are looking for but that is the answer
