After hostile work environment complaint filed, what is the responsibility of the company: what must they do? |
I filed a complaint with my company that I was being subjected to a hostile work environment by another employee, (not sexual), pt writing offensive/threatening emails to me at work. Once I file the comlaint, what is the companies responsibility? how long do they have to get back to me witha solution?. are they obliged under law to get to the bottom of it within a certain time frame? All sorts of things can create what employees deem to be a "hostile work environment". But, in the legal sense, a hostile work environment is caused by unwelcome conduct in the workplace, in the form of discriminatory harassment toward one or more employees.There are no Federal "hostile work environment laws" or "hostile workplace laws" named as such. Creating a hostile workplace is prohibited under certain Federal discrimination laws Subsequently, to be illegal under one of the laws in the eyes of the courts, a hostile work environment must be caused by discriminatory workplace harassment based on race, color, religion, national origin, disability, age or sex. Additionally, the harassment typically must be severe, recurring and pervasive. Lastly, the victim or witnesses must reasonably believe that tolerating it is a condition of continued employment. The short answer is that you should talk to either your supervisor or your HR director. If you fail to get results, consider talking to the President of the company. If ALL ELSE fails, have a lawyer send a letter to the company. your the only unhappy person after the happy employee's are interviewed all happy and portray you as the "troubled one" well i think you can figure it out... so be prepared for that......... everyone else is happy your the "disgruntled one" even i can do the ..outcome.. I'm not sure there is a set timeframe. However you need to give them a couple of weeks to look into the situation. Sometimes the wheels more slowly at a big corporation. However, that doesn't mean you should let it slide. Give them no more than 2 weeks, then contact whoever you filed the complaint with and ask for an update. Keep on him/her until you get a satisfactory resolution. |
