Mother served with a summons meant for me? |
My mother just received a summons meant for me. I assume I have to appear in court but she's in panic mode so I can't understand a word she's saying. I'm not living there right now- I'm in a foreign country. I haven't been there in about 7 months. I never even heard of the creditor that she mentioned. Do I really need to respond? How can they even prove that I received the papers if I myself wasn't there to receive them? Can this be dismissed for lack of service? Do I inform by mail or make a phone call? If you don't appear, the creditor will win a default judgment against you. Call the law firm listed on the summons and find out what is going on and why you are being sued. Ignoring it will not help but neither will panic. After you talk to them by phone, follow up with a certified letter with any important information. Good luck this is what I found in the statutes as acceptable form of service of process- (B) Delivering a copy of the summons and complaint at the individual's dwelling place or usual place of abode to a member of the individual's family who is above the age of sixteen (16) years and by advising such person of the purport of the summons and complaint Whether or not you know the creditor, it may be best for you to respond in writing regarding the summons your mother recieved in your name. Explain to these people that you are out of country, and if you are in the military, they will request a copy of your orders if you actually are a past member from this creditor. If you are not, and you do not recollect ever being in debt to this creditor, you need to ask them what you need to do to get it cleared up while you are not state side. i agree call clear it up, don't forget identity theft, you might save yourself. Bills are payable small amount amount. payment plans. But identity theft hurts, I would want to know. Honestly, you need not worry since summons have not been received by you. I understand from your issue that Your mother had received summons for you being default. If your mother is not a party to the deal, she can respond so.
