My friend has to give me Rs.5,000. He gave me a cheque in October 2005, i went to bank twice, cheque bounced two times, from then onwards he is saying i will pay today/tomorrow, like that it went. Recently in June 2007 he gave me Account payee cheque, i deposited cheque in my account twice and cheque bounced two times, now i came to a conclusion he will not pay the money. I want to file a case againt this person. Please provide the various sources to file a case against this person in Bangalore, Karnataka, India. Please suggest various ways how can i put him in trouble and get my money back. I will be highly thankful to you.
The best way is to give him a registered letter demanding your payment. After 3 reminders if he do not pay then catch hold of an advocate and file a case under negotiable instrument act. The order is passed very quickly in these type of cases and are treated as criminal offence. You must claim original amount + Interest + mental agony in total minimum 50,000 should be claimed. Bangalore police or file a case against him in a court through a lawyer. but is is a very small amount u will have to spend much more that whta u have to take back from your friend Pl send a registered notice advising him of the dishonour and bouncing of the cheque. Also prefer a criminal compaint with the police in whose jurisdiction your residence comes or of the drawer of the cheque. With lodgement of the FIR against the person the police will take up the matter proceed against the drawer of the cheque. Please ensure that the reasons for return of the cheque are financial and not technical. Good luck
