Who has possession of home? |
Trying to evict tenant through court.. during the hearing the judge was not present (his law clerk sat in )tenant said she had moved out as of June; yet, she did not notify me of the move and stated she could not return the keys until all her belongings were out of the house (only stove and frig left) court clerk stated person wanting to enter must notify person with possession before entering. I took it as I have possession because she stated she had moved and gave court a new address. am right or wrong?? You are correct. She needs to notify you if she wants to enter the property again or she is trespassing and entering the home illegally. As soon as she notified the court she had an address other than the one in question she is no longer the person in possession. change lock asap and call police should they proceed to trespass http://www.theforeclosuresinfo.com/forec... |
