What is the difference between a "brand" and a "trademark"? |
Can you explain what is a brand and a trademark? defining only both... As simple as it can be: A brand includes a name, logo, slogan, and/or design scheme associated with a product or service. Brand recognition and other reactions are created by the use of the product or service and through the influence of advertising, design, and media commentary. A brand is a symbolic embodiment of all the information connected to the product and serves to create associations and expectations around it. A brand often includes a logo, fonts, color schemes, symbols, and sound, which may be developed to represent implicit values, ideas, and even personality. A trademark or trade mark[1] is a distinctive sign or indicator of some kind which is used by an individual, business organization or other legal entity to uniquely identify the source of its products and/or services to consumers, and to distinguish its products or services from those of other entities. A trademark is a type of intellectual property, and typically comprises a name, word, phrase, logo, symbol, design, image, or a combination of these elements. There is also a range of non-conventional trademarks comprising marks which do not fall into these standard categories. The owner of a registered trademark may commence legal proceedings for trademark infringement to prevent unauthorised use of that trademark. However, registration is not required. The owner of a common law trademark may also file suit, but an unregistered mark may be protectable only within the geographical area within which it has been used or in geographical areas into which it may be reasonably expected to expand. The term trademark is also used informally to refer to any distinguishing attribute by which an individual is readily identified, such as the well known characteristics of celebrities. They can be the same thing. A brand is the name of a product, such as Dell, Tide, Pepsi, or Chevrolet. A trade mark is a symbol used to identify a product. The trade mark is registered with the Patent Office and provides legal protection for the brand. The symbol can be the brand name presented in a particular form, such as the oval Ford symbol or the name DELL with the E tilted to the left. You can create a brand without registering it as a trade mark, however, it would not have the protection a trade mark offers. |
