Does she have the right?



My boss has decided to close her cleaning company up. However, she is splitting the customers of the business between myself and my other colleague so that we can both start up our own businesses. The name of the company has been closed. BUT...my other colleague wants to use the ex-company name as her new name for her business. Is the right? Or is she just being selfish? I have to use a new name for my new business, I just don't think it's fair!

Did the other employee buy her business from her? You can't have the same name as an existing business registered with your state....

Rather than asking the online community about the fairness of the situation, you should probably talk to your boss and find out what the deal is...
Then get in before her and register it for yourself - then she's stuffed - she'll do it to you coz the business name is associated and old, existing and potential customers will look for it.

Golden Rule - NO FRIENDS IN BUSINESS
If you can't get the name, see if you can beat her to the old company's phone number.
i guess she can, but only if the compny name is not already registered. Why don't you use the the old company name as well, or one that is very similiar to it
You cannot register a trading name in the UK unless you are a limited company, so you can trade as anything you like, including the name your colleague wants. However, two of you trading under the same name isnt going to do either of you any good. Have you thought about going into partnership together?
The company name (if registered) is a commodity no differnet from a tin of peas, it can and if your former boss has sense be sold. It is potentially more valuable than the business.

If it is not registed it has no value and no protection.

Either bid for the name, or maybe bid for the telephone number the clients know! That has value too!

Either way fair has little to do with what is legal.

Gain some cred with your client base, set a competition to name the new company.
