Can I appeal a name search for a company name? |
i have put in a name seach for Kim's Family Daycare in BC Canada and they denied it because there is a Kim's Family Enterprises.... can i appeal the decision because they are not close to where someone would get them confused?? At first blush.. no you cannot. Canadian law would dictate here, but in America, service mark, company name and trademark law would come into play. Trying to successfully win an appeal can be VERY costly, and the outcome is far from sure. I'd find a different name... if they accep t it |
