Does my friend have to claim his soon to be ex-wife on his tax return?



They are not legally separated or divorced yet but working on it.She has not lived with him in over 1 1/2 years.

The IRS says you are either married or you're not. So for their purposes your friend was married at the end of tax year 2005. However that doesn't mean that he MUST claim his wife, only that the option is available. The can each file as "Married filing Separately" and each can claim themselves. It might be better for them to agree to file jointly since they would probably pay less tax that way. If they aren't on speaking terms this option is most likely out. Source(s): IRS publications.
It more than likely will depend on how many months they resided together for the tax year that they are filing.
If they where not living together at the end of the year, then no, he does not have to claim her.
No he doesn't have to claim her if they have lived apart for over a year. But he will have to file SEPARATE. The IRS doesn't favor that filling status. You get more credits by filling a JOINT RETURN!!

Unless your friend has a dependent that he supported more than half of the year(Head of Household), then he will have to file married filing jointly or married filing separately.
